Terms of Service

These Terms of Service ("Terms") govern all sales of products concluded at a distance between SBQ-Ecom Agency and any consumer ("the Customer") placing an order through the website https://celiglow.com ("the Site"). Placing an order on the Site implies full and unconditional acceptance of these Terms by the Customer.

2. Purpose and Scope

These Terms set out the rights and obligations of the parties in connection with the online sale of Celiglow skincare and personal-care products (including creams, serums and related cosmetic items) offered by SBQ-Ecom Agency to consumers located in Australia and, where applicable, in other delivery zones offered on the Site.

The Customer acknowledges having read these Terms at the time of placing the order and accepts them without reservation. The applicable Terms are those in force at the date the order is confirmed.

3. Products

The products offered for sale are those listed on the Site at the time the Customer accesses it, subject to availability. Photographs, visuals and descriptions illustrate the products as accurately as reasonably possible, but minor variations may occur due to screen resolution, lighting or manufacturing tolerances and are not binding on the seller in this respect.

SBQ-Ecom Agency reserves the right to modify its product range, technical specifications and visual presentation at any time and without notice.

4. Price and Taxes

Prices are displayed in Australian Dollars (AUD), inclusive of all applicable taxes where required by law, excluding shipping costs. Any applicable shipping cost is calculated and clearly displayed before the Customer finalises the order.

Where SBQ-Ecom Agency is registered for Goods and Services Tax (GST), GST is included in the displayed price. Where the seller is not registered for GST, the displayed price reflects the seller's pricing without GST; for low-value imported goods (A$1,000 or less), GST may be collected at point of sale where required by the GST legislation applicable to overseas suppliers.

SBQ-Ecom Agency reserves the right to amend prices at any time. Products are however invoiced on the basis of the prices in force at the time the order is confirmed by the Customer.

5. Orders

The Customer may place an order directly on the Site by selecting the products of their choice, adding them to the cart and confirming the order after providing the information required for delivery and payment.

The order process includes the following steps: product selection, cart review, entry of delivery and billing details, choice of payment method, express acceptance of these Terms, and final confirmation of the order.

The order is only deemed concluded once payment has been confirmed and a confirmation email summarising the order has been sent to the Customer. SBQ-Ecom Agency reserves the right to refuse or cancel any order in case of prior dispute, manifest pricing error, suspected fraud or stock unavailability.

6. Payment Methods

The Customer may pay for the order using the following methods:

  • Credit / debit card (Visa, Mastercard, American Express) via Shopify Payments
  • Apple Pay
  • Google Pay
  • PayPal

Payment is made in full at the time the order is placed. Card transactions are secured by the relevant payment providers using industry-standard encryption protocols (TLS, 3-D Secure). Card details are at no time stored by SBQ-Ecom Agency.

7. Delivery

Products are delivered to the address indicated by the Customer at the time of the order. Delivery zones, lead times and shipping fees are set out in the Shipping Policy available at https://celiglow.com/pages/shipping-policy.

For information, the dispatch lead time is zero to three (0 to 3) business days, and the delivery lead time within Australia is two to seven (2 to 7) business days after dispatch. On average, all Customers receive their parcel within five to seven (5 to 7) business days from order confirmation, dispatch time included.

Risk in the goods passes to the Customer on delivery.

8. Australian Consumer Law and Consumer Guarantees

The products sold on the Site come with consumer guarantees under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be excluded. These guarantees include, in particular:

  • Acceptable quality: the goods are safe, durable, free from defects and fit for the purposes for which goods of that kind are commonly supplied
  • Fit for any disclosed purpose
  • Match the description, sample or demonstration model
  • Express warranties given by the manufacturer or seller are honoured
  • Spare parts and repair facilities are reasonably available, where applicable

The Customer is entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. The Customer is also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

9. Returns, Exchanges and Refunds

Detailed conditions for returns, exchanges and refunds are set out in the Returns and Refunds Policy available at https://celiglow.com/pages/refund-policy. Customers must contact the customer service team prior to returning any product. Returns made without prior authorisation may be refused.

Skincare and cosmetic products that have been unsealed, opened, used or otherwise tampered with cannot be returned for change-of-mind reasons due to health and hygiene considerations, except where the product is faulty, damaged, unsafe or not as described. In such cases, the Customer's rights under the Australian Consumer Law continue to apply.

10. Title and Risk

Title in the goods remains with SBQ-Ecom Agency until the price has been paid in full by the Customer. Risk in the goods passes to the Customer on delivery.

11. Personal Data

The Customer's personal information is collected and processed in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). 12. Force Majeure

SBQ-Ecom Agency shall not be liable for any failure or delay in performing its obligations arising from an event of force majeure beyond its reasonable control, including but not limited to natural disasters, fire, flood, strike, industrial action, pandemic, governmental decision, supplier failure, transport or telecommunications disruption.

13. Customer Service and Complaints

For any complaint, the Customer may contact customer service by email at contact@celiglow.com. Customer service aims to respond within 24 to 48 business hours.

In the event of an unresolved complaint, the Customer may also refer the matter to the relevant State or Territory consumer affairs body (e.g. NSW Fair Trading, Consumer Affairs Victoria) or to the Australian Competition and Consumer Commission (ACCC) at https://www.accc.gov.au.

14. Intellectual Property

All content published on the Site (text, photographs, visuals, logos, trademarks, graphics, architecture) is the exclusive property of SBQ-Ecom Agency or its licensors. Any reproduction or representation, in whole or in part, without prior written authorisation is prohibited and may amount to an infringement of intellectual property rights under Australian and international law.

15. Amendment of Terms

SBQ-Ecom Agency reserves the right to amend these Terms at any time. The Terms applicable to any order are those in force on the date the order is placed by the Customer. Customers are encouraged to consult the latest version online at https://celiglow.com/pages/terms-of-service.

16. Governing Law and Jurisdiction

The corporate matters of SBQ-Ecom Agency are governed by Swiss law and fall within the jurisdiction of the courts of the Canton of Vaud, Switzerland.

For sales to Customers located in Australia, these Terms are governed by the laws of the Commonwealth of Australia and of the State or Territory in which the Customer is resident. The non-excludable consumer guarantees of the Australian Consumer Law apply in all cases, regardless of any provision to the contrary.

In the event of a dispute, the Customer is encouraged to seek an amicable resolution with SBQ-Ecom Agency before commencing any legal action. Failing amicable resolution, the courts of the Customer's State or Territory of residence shall have jurisdiction.
